Mom’s $800K Disability Case Lost Over Tree-Throwing Contest Photos”

Kamila Grabska, a 36-year-old Irish woman, had filed a claim for $820,000 in injuries following a crash in 2017. She sued an insurance company, citing constant neck and back pain as a result of the incident.

However, her claim was dismissed by an Irish court after a photograph emerged showing Grabska tossing a 5ft spruce at a charity event in January 2018. The court deemed this inconsistency as a significant factor in rejecting her claim.

Despite Grabska’s assertions of enduring pain and disability hindering her daily life since the crash, the court found the photograph, depicting her actively participating in a physical activity, contradictory to her claims of sustained injuries.

Justice Carmel Stewart, presiding over the case, emphasized the impact of the “very graphic picture” showing Grabska engaged in agile movement while throwing the Christmas tree. This evidence led the judge to conclude that Grabska’s claims were exaggerated, resulting in the dismissal of her case.

Grabska defended herself, stating that she was still in pain during the tree-throwing competition and had quit her job after the crash, subsequently collecting disability. She argued against accusations of faking her injuries, asserting her desire to lead a normal life despite the challenges posed by her alleged injuries.

Additionally, alongside the photo of Grabska participating in the tree-throwing competition, a video was presented in court showing her training her dog outdoors for over an hour in November 2023. These pieces of evidence further contributed to the court’s decision to dismiss her claim.

In light of these developments, Grabska’s claim for compensation was ultimately denied, highlighting the importance of consistency and credibility in legal proceedings involving personal injury claims.
