The Mathura district court ruled on Thursday that a petition to remove the Shahi Idgah Masjid from the Katra Keshav Dev Temple complex is valid.
The lower court, which had previously dismissed the plea, must now hear it.
On September 25, 2020, Lucknow resident Ranjana Agnihotri and six others filed the plea in the lower court — the court of civil judge senior division — as the “next friend of Bhagwan Sri Krishna Virajman.”
They alleged in the petition that Shahi Idgah Masjid is built on 13.37 acres of land owned by the Sri Krishna Janmabhoomi Trust. They wanted the mosque demolished and the land given back to the Trust.
On September 30, 2020, the civil judge senior division dismissed the lawsuit as inadmissible.
The petitioners then went to the court of district judge, asking for the order to be revised.
District and Sessions Judge Rajeev Bharti authorised the amendment on Thursday after hearing the arguments, which means the original suit will now have to be heard by the lower court, according to a court official.
