The Supreme Court on Monday halted a Delhi High Court ruling concerning the filing of a First Information Report (FIR) against BJP leader Shahnawaz Hussain on a rape accusation.

The Delhi High Court, while criticising the Delhi Police for its “total hesitation” to even lodge a FIR against BJP leader Hussain, ordered it to do so immediately and conclude the probe into the rape claims against him within three months.

Justice Asha Menon upheld a lower court order from 2018 directing the police to register a FIR against Hussain, saying the victim’s complaint to the commissioner of police in 2018 clearly disclosed the cognisable offence of rape “after administration of a stupefying substance,” and when the complaint was forwarded to the station house officer, the officer was obligated under law to register the FIR.
