Supreme Court on Monday will hear a number of pleas contesting the Karnataka High Court’s decision upholding the state government’s ban on hijabs in educational settings.
Tomorrow, the new Chief Justice of India UU Lalit’s first working day, the appeals will be heard by a bench of Justices Hemant Gupta and Sudhanshu Dhulia. The petitions were previously brought up before a bench led by the former Chief Justice of India, NV Ramana, on a number of occasions for an urgent hearing, but the matter was not scheduled for hearing.
Karnataka government’s directive for stringent implementation of the uniform regulations for schools and colleges was challenged in the appeals filed with the Supreme Court.
An unwelcome law and order scenario was created as a result of government officials’ allegedly “stepmotherly behaviour,” according to one petition before the Supreme Court.
According to the appeal, which was filed in response to the impugned order it stated ” High Court had vehemently failed to apply its mind and was unable to understand the gravity of the situation as well as the core aspect of the Essential Religious Practices enshrined under Article 25 of the Constitution of India.”
It has been stated that wearing a headscarf or hijab is a custom that is crucial to practising Islam.
Karnataka High Court ruled in March that students could not object to the need of uniforms as a legitimate limitation, and it dismissed many petitions against the wearing of the hijab in educational facilities on the grounds that they lack validity.
When the Government PU College in Udupi purportedly forbade six females wearing the hijab from attending, the hijab controversy arose in January of this year. The females then sat in protest outside the college after being turned away.
