Influencer Ashley St Clair has filed a paternity suit against billionaire tech mogul Elon Musk, seeking sole custody of her five-month-old son. Musk has not publicly acknowledged the child. The legal petitions were submitted in Manhattan Supreme Court on Friday, setting the stage for a high-profile custody battle.
Request for Paternity Test and Custody Rights
St Clair’s court filings request that Musk be legally recognized as the child’s father. She has also demanded that the Tesla CEO undergo a genetic test to confirm paternity, according to reports by the New York Post. Her legal documents state that the child was conceived in January 2024 during a trip to St. Barths.
In a separate custody filing, St Clair alleged that Musk was absent for the child’s birth and has only met the baby three times—twice in Manhattan and once in Texas. She further stated that Musk has neither requested to see the child more frequently nor asked for updates or photographs.
Text Message Evidence Submitted in Court
As part of her filing, St Clair included a photograph of herself holding the infant, along with alleged text message exchanges with Musk. One of the messages reportedly shows Musk, saved in her phone as “EM,” responding to a photo of the newborn with the brief question, “All well?”
St Clair replied, “He is perfect.” To which “EM” responded, “I look forward to seeing you and him this weekend… Falling asleep. Hope the recovery goes well.”
Another message from “EM” stated, “I want to knock you up again,” after St Clair had sent him a picture of herself. When she expressed concerns about communication issues, Musk reportedly replied, “Hmm ok… Well, I do have a legion of kids to make.”
Concerns Over Privacy and Public Reactions
St Clair also revealed that she deliberately left the father’s name blank on the child’s birth certificate due to security concerns. She cited Musk’s previous statements about receiving “credible death threats every day” as a reason for this decision.
Although Musk and St Clair had previously engaged with each other’s social media posts, the billionaire has yet to directly address the paternity case. However, he did react to an online claim suggesting that St Clair had been planning to “ensnare” him for years. Musk’s response was a single-word reply: “whoa.”
St Clair Calls Out Musk’s Public Response
In response to Musk’s engagement with online speculation rather than directly addressing the lawsuit, St Clair wrote, “Elon, we have been trying to communicate for the past several days, and you have not responded. When are you going to reply to us instead of publicly responding to smears from an individual who just posted photos of me in underwear at 15 years old?”
