Aam Aadmi Party (AAP) MLA Prakash Jarwal and his associate Kapil Nagar were found guilty on Wednesday by the Rouse Avenue court of aiding and abetting a doctor’s suicide. Additionally, they were found guilty of criminal conspiracy to threaten and extort the late Rajender Singh.
In addition to being a doctor, the deceased was involved in tanker water supply.
Prakash Jarwal and Kapil Nagar were found guilty by special judge M K Nagpal of aiding and abetting suicide, extortion, attempting to extort, criminal intimidation, and criminal conspiracy for extortion.

Section 506 (Criminal Intimidation to Kill) Part 2, which carries a maximum sentence of seven years, has been used to find them guilty.
Harish Jarwal, the third accused, was found guilty of the crime of criminal intimidation.
The prosecution has proven the allegations beyond a reasonable doubt, the court declared.

On behalf of Delhi police, Additional Public Prosecutor (APP) Manish Rawat made an argument.
The prosecution and the accused parties have been ordered by the court to submit their affidavits. The hearing on the matter is scheduled for March 13.
The court filed charges under various IPC sections against Prakash Jarwal, Kapil Nagar, and Harish on November 11, 2021.

The court stated that the accused Prakash Jarwal and Kapil Nagar were prima facie proved guilty of the offenses under Sections 120 B IPC read with Sections 386 (extortion by putting a person in fear of death or grievous hurt), 384 (extortion), and 506 (criminal intimidation); additionally, the accused were found guilty of the offenses under Section 384 read with Section 120 B (Criminal Conspiracy) IPC, Section 386 read with Section 120 B IPC, Section 506 read with Section 120 B IPC, and also under 306/34 IPC.

The accused Harish was charged by the court under Section 506 IPC, but he was released from custody for the offense under Sections 306 and 386 IPC.
Hemant Singh’s complaint, dated April 18, 2020, was the basis for filing a formal complaint. In it, Singh claimed that his late father, Rajender Singh, had been providing water supply through tankers since 2005. His father had never been harassed by Delhi Jal Board.
But he claimed that after the accused Prakash Jarwal emerged victorious and was elected as an MLA for the Aam Admi Party, he and his colleague Kapil Nagar, who collaborated with him, began persistently pestering his father for money.

According to the allegations, accused Kapil Nagar used to take money each month and give it to accused Prakash Jarwal at his request. The accused, Prakash Jarwal, was a member of the Delhi Jal Board and prohibited the use of their tankers by the Jal Board without collecting the monthly fee.

Additionally, it was mentioned that the complainant’s father had begged the accused Prakash Jarwal on multiple occasions not to bother him because he had a heart condition, but the accused Prakash Jarwal had recorded his father’s phone calls and did not listen.

It was further claimed that Prakash Jarwal, the accused, used his influence to halt the deceased’s payment. In addition to mentioning the money allegedly given to accused Prakash Jarwal—which was taken against his will—the complainant’s father also wrote in his diary about the mental harassment.
It was claimed that the deceased used to be troubled and would write about the incidents in his diary because of the pressure and exploitation he endured.
Additionally, it was claimed that the complainant’s father had sold his ancestral land, taken out a loan against his wife’s jewelry (for which they had receipts), and given the money to Kapil Nagar at accused Prakash Jarwal’s request.
