Supreme Court will hear various appeals against Karnataka High Court’s judgment upholding the prohibition on Hijab in educational institutions today at 2 pm.
On August 29, the Supreme Court sent the Karnataka government notice on a range of pleas contesting the Karnataka High Court’s decision to sustain the hijab ban in educational institutions.
Justices Hemant Gupta and Sudhanshu Dhulia’s bench stated clearly that it would not accept requests to postpone the case.
The court had stated that it will hear the case on September 5 about a petition for a stay and a challenge to the decision of the Karnataka High Court.
The Karnataka High Court ruling upholding the Karnataka government’s Hijab ban order for rigorous enforcement of schools’ and institutions’ uniform regulations has been challenged by various petitioners in front of the Supreme Court.
An unwelcome law and order scenario was created as a result of government officials’ allegedly “stepmotherly behavior,” according to one petition before the Supreme Court.
The High Court “had vehemently failed to apply its mind and was unable to understand the gravity of the situation as well as the core aspect of the Essential Religious Practices enshrined under Article 25 of the Constitution of India,” according to the appeal, which was filed in response to the impugned order.
A bench of the Karnataka High Court made up of Chief Justice Ritu Raj Awasthi, Justice Krishna S. Dixit, and Justice J.M. Khazi had previously ruled that the necessity of uniforms is an acceptable restriction to which students cannot object and that multiple petitions contesting the prohibition of the hijab in education setting lack merit.
