CJI Lalit recuses to hear plea in land case

Chief Justice of India UU Lalit announced his decision not to hear the land issue appeal of former Chief Minister of Karnataka B S Yediyurappa.

The former chief minister of Karnataka, B S Yediyurappa, filed a petition on Friday contesting the Karnataka High Court’s decision to reinstate the criminal charge against him in connection with the alleged falsification of papers regarding the revocation of clearance for a piece of property in the state. Chief Justice of India UU Lalit recused himself from the case.

The Supreme Court’s proper bench, of which Chief Justice Lalit is not a member, has been ordered to take up the case after Diwali. Yediyurappa’s appeal against the Karnataka High Court ruling from January 5, 2021, in which the HC reinstated a criminal case against him, former industries minister Murugesh R. Nirani, and another accused was being heard by the Supreme Court.

B S Yediyurappa was given temporary protection from arrest in this case by the court on January 27, 2021.

In order to reverse the approval given by the High-Level Clearance Committee for the allocation of 26 acres of land to the complainant at Devanahalli Industrial Area, Bengaluru Rural District, the respondents Yediyurappa and others were accused of engaging in a criminal conspiracy and forging documents.

A Alam Pasha filed the case in an effort to have Yediyurappa punished for suspected offences under sections 418, 465, 468, and 471 of the Indian Penal Code (IPC) read with 120B and sections 13(1)(c), 13(1)(d)(ii) of the Prevention of Corruption Act.
